Lessons from COVID 19: Examining the History and Context of the 2024 New York Health Equity Reform Waiver Amendment

Abstract

This paper examines the history of the Affordable Care Act and Medicaid Program in the development of the 2024 New York Health Equity Reform (NYHER) waiver amendment under Section 1115(a) of the Social Security Act. This amendment serves to reform the Medicaid program in New York State, focusing on addressing health disparities and health-related social needs (HRSN). This includes housing, security deposits, and more funding for case management services that facilitate improved access to health care and social care for individuals. New York State was hit extremely hard by the pandemic, hospitals were overwhelmed with patients and equipment shortages, and the state had to pause economic outputs due to the severity of the emergency. The devastating impacts of the pandemic, as well as the expiration of the Delivery System Reform Incentive Payment Program on March 31, 2020, led to the creation, and later implementation, of the NYHER amendment.
